New Partner: The Firm is pleased to welcome
Mitch Ziontz as a new partner, effective as of March 19, 2007. Mitch is an
experienced real estate transactional attorney who comes from Appel Law
Partners in Century City. Mitch has significant experience handling all
aspects of real estate transactions, with a focus on commercial lease
matters. In addition to practicing law, Mitch loves to spend time outdoors

Regional Water Board Success: Partner Tom
FitzGibbon assisted a Firm client in the seafood processing business and the
Crescent City Harbor District in avoiding significant penalties under the
California Water Code at a recent hearing before the North Coast Regional
Water Quality Control Board. Instead of paying penalties, the Harbor
District was authorized to use the bulk of the penalty amount to complete a
compliance project at its wastewater treatment plant. This result means
that the environment will be protected through treatment plant upgrades and
the District will be able to continue to serve the seafood processing
industry in Crescent City, which will preserve many jobs in that community.

Jury Trial Success: Partner Jon Pfeiffer
defended a firm client in the entertainment industry at a week-long trial in
April of 2007 before a jury in Los Angeles County and achieved an excellent
result. The case involved claims by the plaintiff seeking recovery based on
contract and a variety of business torts and sought damages in excess of
$1,000,000. Jon helped the company obtain defense verdicts on all of the
tort claims and minimized the expected contract award to the plaintiff.

Settlement of Litigation by MySpace: Firm
Partner Tom FitzGibbon recently assisted a publicly traded company in
defending against federal court litigation brought by MySpace, Inc. arising
out of the client’s marketing campaign. MySpace sought hundreds of millions
of dollars in damages from the client for a variety of claims, including
those based on the CAN-SPAM Act, trademark infringement and California
statutes concerning electronic messaging. The matter was successfully
resolved through a confidential settlement after a mediation at JAMS before
neutral Jeff Kichaven.

Jury Trial Victory: In June 2005, partners Jon
Pfeiffer and Tom FitzGibbon won a three-plus week jury trial in Los Angeles
County Superior Court, Norwalk, on behalf of client NuCentury Textile
Services. The opposing side, represented by the Akin Gump firm, sought to
have NuCentury pay over $3,000,000, but instead NuCentury prevailed and the
jury awarded the company over $460,000, plus the right to recover interest
and attorneys' fees. In the Spring of 2006 the matter was resolved in full
when NuCentury received a payment of $1,000,000 from American Textile
Maintenance Co. The case involved a complex business dispute with
significant environmental issues regarding wastewater discharge from an
industrial facility.
