  • Property Damage Case: Partner Tom FitzGibbon recently achieved a favorable settlement for a client whose property was damaged by a landslide caused by a developer’s negligence in maintaining erosion control measures on a $100 million development project. The case involved relief from a bankruptcy stay and technical discovery and the use of experts, including regarding mold.  The matter was resolved through mediation with George Calkins at JAMS.

  • Appellate Success: Kim Thigpen recently obtained an excellent result for an important client with the Second District Court of Appeals’ affirmance of nearly all of the trial court’s order sustaining a demurrer without leave to amend, as only one cause of action was allowed to be repleaded, but the plaintiff did not replead to state a cause of action. The matter involved claims relating to the sales practices for a health insurance policy.

  • Dismissal of Action: Partner Levi Heath obtained for a major national life insurance carrier the dismissal of all claims relating to a life insurance policy through the interpleader process. The case was vigorously contested and involved a great many procedural battles, but through diligence and skillful litigating, Levi was able to obtain complete vindication for the client.

  • Jury Trial Success:  Partner Jon Pfeiffer defended a firm client in the entertainment industry at a week-long trial before a jury in Los Angeles County and achieved an excellent result.  The case involved claims by the plaintiff seeking recovery based on contract and a variety of business torts and sought damages in excess of $1,000,000.  Jon helped the company obtain defense verdicts on all of the tort claims and minimized the expected contract award to the plaintiff.

  • Removal Of Mechanics’ Liens: Partner Tom FitzGibbon recently achieved favorable resolutions of two actions by filing pre-emptive motions to remove invalid mechanics‘ liens. One resulted in the complete dismissal of the action against the client in Santa Clara Superior Court with the second allowing the client to sell over $30 million worth of residential real estate and later favorably resolve the claims through settlement.

  • Pro Bono Success:  Partner Tom FitzGibbon assisted a Firm client in winning a case through the use of an anti-SLAPP motion.  The case involved allegations of defamation against a whistleblower who was a witness in a USADA arbitration proceeding charging a bicycle racer with doping in cycling. The Los Angeles Superior Court dismissed the defamation action and the matter settled on a confidential basis as to the attorneys fees to be awarded to the Firm and its client.
